These Terms of Service ("Terms") govern your access to and use of the website located at mdrwatchdog.com (the "Site"), operated by Darrell Rhodes, doing business as MDRwatchdog ("MDRwatchdog," "we," "us," or "our"). The MDRwatchdog name and mark are trademarks of Darrell Rhodes d/b/a MDRwatchdog. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MDRWATCHDOG, ITS OWNER, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

8. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
